Terms and Conditions of Use and Sale (TOS / T&C)

Panda Network Limited (also called: “revyp.com”) is a Hong Kong company, located at Rm A, 19/F, Max Share Centre, 367-373 King's Road, North Point, Hong Kong and registered under the number 67665704. Revyp.com can be contacted by email at [email protected] or by phone at 01 85 09 20 22.

Revyp.com offers its users (also called: “Client” or “Clients”) a reverse directory service, which can be used to identify a person from their phone number. (also called: the “Service”) This Service is performed on the website https://revyp.com/ (also called: “the User Interface” or simply “the Interface”)

The general terms and conditions of sale (also called: the “General Conditions”) represent the sole and unique document governing the contractual relationship between revyp.com and the Client. These conditions exhaustively define the terms of use of revyp.com’s services as well as the respective obligations of both parties.

Access to the service is conditional upon obtaining the Client’s explicit agreement during their order. This agreement is given when the Client checks a box attesting that they have read and accepted the general conditions at the time of purchase. If these conditions are not met, access to the service will be denied.

The General Conditions can be found at any time by the Client via a link at the bottom of the site page and can be consulted via a clickable link during the purchase.

Before any subscription, the Client acknowledges that they are able and must be aware of the characteristics of the Services and their constraints, particularly technical ones, by consulting the information available on the Interface and by carefully reading the General Conditions before checking the acceptance box.

The Client acknowledges that the implementation of the Services requires a functional Internet connection, that the quality of the Services depends on this connection for which revyp.com cannot be held responsible.

The Services to which the Client subscribes during their purchase are described on the Interface and in the General Conditions.

The Service consists of attempting to identify a person using their phone number, on a global scale. After the Client has submitted the phone number on the Interface, as well as the indicator corresponding to the country of the number, revyp.com consults its internal database to retrieve information related to the number.

The identification of the person linked to the phone number, and the transmission of this information to the Client, will only be possible and achievable if the internal database is able to provide this information.

If this information is not found, the Interface automatically sends an SMS to the number submitted by the Client to ask the recipient to share their contact information.

From their trial period, and until their subscription is terminated, the Client has a User Interface where they can consult the number’s information and has the right to search for information concerning other numbers, they also have an email alert, when revyp.com finds the information.

The Client accepts that the Service consists of a set of means put in place by revyp.com and does not in any way constitute a guaranteed result from the platform. These means are defined as: searching the internal database, an external database of operator data, and sending an SMS to the number provided by the Client. The Client also accepts that revyp.com is not responsible if the information provided by the recipient is incorrect. revyp.com reserves the right to offer any other Service. If revyp.com modifies its services, a new subscription must be made.

revyp.com ensures an obligation of means which consists of hosting the Interface, as well as hosting the data entered on the Interface, on its servers or through a professional hosting provider with whom we have concluded a GDPR data processing agreement.

The technical support service is available from Monday to Sunday, from 8 a.m. to 7 p.m. In case of a technical problem, the response time will be estimated by the team and the Client will be informed of it by email.

The Client, during their purchase phase, subscribes to the Service, in the form of a subscription (also called the “Subscription”).

This Subscription begins on the day of its first subscription, the trial period for the platform is 24 hours. (Defined as the “Trial Period”)
At the end of this Trial Period, if the Client has not requested termination within the first 24 hours, the Subscription is tacitly renewed for a monthly amount of €47.90 including VAT. VAT applies if you reside in the European Union and is already included in the displayed price. The VAT rate depends on your country of residence. This subscription is automatically renewed each month and the card used by the Client is automatically debited.

The Client can terminate their Subscription whenever they wish, to do so, they simply need to cancel their Subscription using the “unsubscribe” feature present in their “my profile” option or if they are not logged into the site, the unsubscribe button at the top of the page, or, the unsubscribe button in the “frequently asked questions” section of the site.

If the Client cancels within the first 24 hours, they will then be unsubscribed from their trial period, in the case where the Client cancels after this period, the Client will be unsubscribed at the end of the current month where their unsubscribe request was made.

In accordance with current legislation, the Client has a period of fourteen (14) calendar days from the date of conclusion of the service provision contract to exercise their right of withdrawal, without obligation to justify their decision. In the event of withdrawal by the Client, revyp.com will refund all payments received from the Client, without imposing any fees, within a maximum period of ten (10) days from the receipt of the withdrawal notification. The refund will be made using the same means of payment as that used during the initial transaction. The right of withdrawal does not apply in cases where the provision of Services has been used and fully executed before the end of the fourteen (14) day period and this, with the express agreement of the Client, given before the start of the service.

The Interface, as well as all associated software, infrastructures, databases, and content (texts, images, logos, etc.) are the exclusive property of revyp.com and are protected by the intellectual property rights in force. The Client is granted a non-exclusive, personal, and non-transferable license to use the Platform, in accordance with the terms defined in section 7 Price and Duration of Subscription to the Services.

The Client undertakes to provide revyp.com with all the necessary information to subscribe to and use the Services. They are responsible for the accuracy and completeness of this information. Revyp.com is not responsible for errors, faults, omissions, or any incorrect information that could mislead revyp.com or affect the sending of SMS to the intended recipient.

The Client accepts the General Conditions by checking a box when confirming the order. If they do not accept all of the General Conditions, they cannot access the Services.

The Client undertakes to provide revyp.com with accurate information when subscribing and using the Services, and guarantees their accuracy. They also undertake to update this information regularly. The Client acknowledges that this information serves as proof of their identity and engages their responsibility upon their validation. They are responsible for the confidentiality and security of their identifier and password, any access to the Interface made with them being considered as having been carried out by themselves. revyp.com declines all responsibility in the event of an error, omission or inaccurate information provided by the Client, or which could mislead or affect the transmission of SMS to the intended recipient.

Revyp.com undertakes to implement all necessary means to provide the Services in a diligent manner. It is important to note that revyp.com is bound by an obligation of means, and not of result, which means that it strives to provide the best possible service without guaranteeing a specific result.

Furthermore, revyp.com undertakes to comply with all applicable regulations in the performance of its services.

Revyp.com cannot be held responsible for disruptions or damages associated with circumstances external to its network, including but not limited to the partial or total failure of the Client’s servers. Furthermore, revyp.com declines all responsibility in the event of failure of equipment, wiring, services or networks not included in its Services or which are not under its direct responsibility.

The responsibility of revyp.com cannot be engaged in the event of interruption of the Services due to the actions of telecom operators or internet access providers, nor for any intervention by the Client resulting from a poor configuration or manipulation of the Services.

Finally, revyp.com will not be responsible in case of force majeure, in accordance with the legislation in force. For more information on this subject, the Client can consult section 13 Force majeure.

revyp.com is responsible for processing the Client’s personal data, including the phone number provided during identity identification requests. All identification information obtained is processed in strict compliance with the General Data Protection Regulation (GDPR).

For more information on the data processing carried out, the Client is invited to consult the privacy policy of revyp.com, accessible from the Platform.

Neither the Client nor revyp.com can be held responsible for failures or delays in the execution of their contractual obligations resulting from a case of force majeure occurring during the term of their contractual relationship.

In the event of force majeure, the party prevented from performing its obligations must inform the other party, without delay, by registered letter with acknowledgment of receipt. The contractual obligations will then be suspended immediately upon receipt of this letter and will resume within a reasonable time after the cessation of the force majeure event.

The affected party nevertheless remains bound to the performance of the obligations that are not affected by the case of force majeure, including payment obligations.

revyp.com reserves the right to re-initiate a direct debit in the event of non-payment. revyp.com reserves the right to remove the Client’s access to the Services in the event of inaccurate information damaging its reputation. revyp.com reserves the right to remove the Client’s access to the Services in the event of use of the Service for illegal, fraudulent activities, or which infringe on the security or rights of third parties. revyp.com reserves the right to remove the Client’s access to the Services and to contact the competent judicial services in the event that the Services are used to harass or stalk people. These penalties may be accompanied by claims for damages by revyp.com.

For any other breach, revyp.com will send a written notification to the Client to regularize the situation within a period of 15 calendar days. In the absence of regularization, the Services will be terminated and the Client’s account will be deleted.

revyp.com reserves the right to modify these general conditions of use at any time. In case of modification, we will inform our clients by email at the address provided during registration. The modifications will come into effect upon their publication on our Platform, unless otherwise indicated.

These General Conditions and the resulting Contract are governed by the laws of Hong Kong. In the event of a dispute arising directly or indirectly from these Conditions or the Contract, when our company is the plaintiff, the competent court will be that of the Client’s country of domicile. When the Client is the plaintiff, the competent court will be that of Hong Kong.
